Human rights are basic rights or citizenship inherent in an individual from birth by nature which are given directly by God Almighty which cannot be taken away and revoked and must be respected, upheld and protected by the state, law, government and everyone. for the honor and protection of human dignity. Indonesia is a country based on law. So that the State of Indonesia is obliged to provide human rights protection to every citizen. Meanwhile, a rule of law is a state based on the rule of law. The law is sovereign. The state is a legal subject, in the sense of rechtstaat. Because the country is seen as a legal subject, if it is guilty it can be prosecuted before the court for unlawful acts. Human rights are rights that are inherent in the nature and existence of humans as creatures of God Almighty, and are His gifts that must be respected, upheld and protected by the state, law, government and everyone for the honor and protection of human dignity. The definition of human rights according to Jan Materson in the phrase "Human rights could be generally defined as those rights which are inherent in our nature and without which we can not live as human beings" Humans cannot live as humans. Because of their basic and basic nature, human rights are often considered rights that cannot be revoked or eliminated by anyone, not even any power that has the legitimacy to rape them.
